1. Overview and Acceptance of These Terms

This website, bubblerest.com (the "Site"), is operated by BubbleRest ("we", "us", "our"). By visiting the Site, purchasing from us, or otherwise using any of our services, tools, or content (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), including the policies referenced here — our Privacy Policy, Refund & Return Policy, and Shipping Policy.

If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time; the version posted on the Site at the time of your order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Our store is hosted on Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products to you.

2. Eligibility and Your Account

• By using the Site, you confirm that you are at least the age of majority in your place of residence, or that you have the consent of a parent or guardian.
• You agree to provide current, complete and accurate purchase and account information, and to promptly update it as needed (including your email and shipping address) so that we can fulfil your orders and contact you about them.
• You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
• You may not use our products or Services for any illegal or unauthorised purpose, nor violate any laws in your jurisdiction in connection with your use of the Site.

3. Products, Use and Important Safety Notes

Our products — including The Blackout Mask and sleep earplugs — are consumer sleep accessories intended for normal personal use. They block light and reduce noise. They are not medical devices, are not intended to diagnose, treat, cure or prevent any condition, and nothing on this Site constitutes medical advice. If you have a medical concern about your sleep, hearing, eyes, or skin, please consult a qualified health professional.

• Do not use the mask over open wounds or infected skin; discontinue use if irritation occurs.
• Earplugs reduce ambient noise: do not use them in situations where you must remain able to hear alarms, warnings, or your surroundings for safety. Do not push earplugs deep into the ear canal. Keep earplugs away from children under 3 — small parts.
• Products are intended for adults and are not toys.

The free digital guide ("The Blackout Protocol") contains general lifestyle information only and is provided for educational purposes; it is not medical advice.

4. Orders, Pricing and Payment

• All prices are shown in the currency indicated at checkout and are subject to change without notice, without affecting orders already placed. Applicable taxes are calculated at checkout.
• Promotional pricing, free gifts (such as sleep earplugs and the digital sleep guide), and discount codes are offered for limited periods, may be modified or withdrawn at any time, and cannot be applied retroactively to prior orders. Unless expressly stated otherwise, discount codes cannot be combined.
• We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing or listing errors, or orders that appear to be placed by resellers or distributors. If we cancel an order after payment, you will be refunded in full.
• We may limit quantities per person, per household, or per order.
• Occasionally there may be information on the Site containing typographical errors, inaccuracies, or omissions (including descriptions, pricing, promotions, and availability). We reserve the right to correct any errors and to update or cancel affected orders (with a full refund if already paid).
• Payment is processed at the time of order by our payment providers. We do not store your full card details.

5. Shipping, Delivery and Risk

Shipping is free and tracked on every order. Processing takes 1–2 business days and delivery 3–6 business days, as detailed in our Shipping Policy, which forms part of these Terms. Delivery estimates are given in good faith and are not guaranteed dates; however, if your parcel is confirmed lost in transit, we will reship or refund it in full as described in the Shipping Policy.

6. Returns and the 100-Night Guarantee

The Blackout Mask is covered by our 100-Night Guarantee: you may return it within 100 nights of delivery for a full refund of the price paid, with return shipping at your cost, as detailed in our Refund & Return Policy, which forms part of these Terms. For hygiene reasons, earplugs are replaced if faulty but cannot be returned; digital products cannot be returned. Nothing in these Terms limits your statutory rights as a consumer, including (for UK customers) your rights under the Consumer Rights Act 2015.

7. Intellectual Property

All content on the Site — including text, product copy, images, graphics, logos, the "Bubble Rest" and "The Blackout Mask" names, the design of our packaging, and "The Blackout Protocol" guide — is our property or licensed to us, and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Site without our prior written consent. The digital guide is licensed to you for personal use only and may not be resold or redistributed.

8. User Content and Reviews

If you submit reviews, photos, comments, or other content to us or through the Services ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, edit for length or clarity, publish, and display that User Content in connection with our business (for example, on product pages or in marketing), with or without your name or handle as applicable.

• You confirm your User Content is your own, is accurate and reflects your genuine experience, and does not violate any third-party rights or applicable law.
• You agree not to submit content that is unlawful, defamatory, obscene, threatening, or contains malware or spam.
• We may monitor, edit or remove User Content at our sole discretion, but we are under no obligation to do so and take no responsibility for User Content posted by you or any third party.

9. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations or laws; (d) to infringe our or others' intellectual property rights; (e) to harass, abuse, defame, or discriminate; (f) to submit false or misleading information; (g) to upload viruses or malicious code or otherwise interfere with the security or operation of the Services; (h) to collect or track personal information of others; (i) to spam, phish, or scrape; or (j) to interfere with or circumvent security features of the Services. We reserve the right to terminate your use of the Services for violating any of the prohibited uses.

10. Disclaimers and Limitation of Liability

The Services and all products are provided "as is" and "as available", without warranties of any kind except as expressly stated in these Terms (including the 100-Night Guarantee) or required by law. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.

To the maximum extent permitted by applicable law, BubbleRest and our directors, employees, affiliates, agents and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Services or products. To the maximum extent permitted by law, our total liability for any claim related to an order shall not exceed the amount you paid for that order.

Important: some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights (including under the UK Consumer Rights Act 2015). In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend and hold harmless BubbleRest and our affiliates, officers, agents and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Severability, Waiver and Entire Agreement

If any provision of these Terms is held to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms and the policies referenced in them constitute the entire agreement between you and us regarding the Services, superseding any prior agreements.

13. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. If you are a consumer, you additionally benefit from any mandatory consumer protection provisions of the law of the country or state in which you reside, and nothing in this clause deprives you of the protection of those provisions or of your right to bring proceedings in your local courts where applicable law grants you that right.
